We provide a subscription-based membership scheme called “Carflo” which gives you access to our support services for vehicle repair, breakdown, servicing, glass repairs and many other vehicle related needs. Your personal assistant can even arrange a courtesy car! You will be charged a monthly membership fee in advance. You can cancel at any point, and will continue to have access to our services until the next scheduled billing date. You will not be entitled to a refund of any fees you have paid unless a refund is requested within the first 14 days. Carflo gives users access to Your Personal Assistant, Accident support, Repair and maintenance advice and many other services (together the "service" or "services").

TERMS AND CONDITIONS

These terms and conditions explain our services to you and your obligations to us. Please read these terms carefully before signing up to these services using this website because they apply as soon as you accept them: they are really important. If you have any questions or there is anything that you don’t understand, then please get in touch via our ‘contact us’ form.

These terms and conditions relate to the services we offer and use of the www.carflo.co.uk website by you.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE AND SIGNING UP FOR OUR SERVICES AS THEY CONTAIN LEGAL RIGHTS AND OBLIGATIONS

1. Our contract with you
These are the terms and conditions which apply to your use of the www.carflo.co.uk website and form the contractual relationship between us and you.

2. Changes to these terms and conditions or the services
We may change these terms and conditions at any time, the date of the latest version can be found at the bottom of the page. If changes are made we will put the new terms and conditions or details of the changes on the www.carflo.co.uk website. The changes will take effect when they are posted on the www.carflo.co.uk website. You agree to check this page from time to time to take notice of any changes that are made to these terms.

3. Using our services
Our services are only open to our members. To become a member, please see clause 6 below:

-3.1 Membership Rules

-3.1.1 After becoming a member you must keep to these rules.

- 3.1.2 Membership is personal to the person accepting these terms.

- 3.1.3 Membership is non-transferable.

- 3.1.4 Membership cannot be used by persons other than the member.

- 3.1.5 You shall ensure that no other persons have access to your membership details and you must keep them safe and confidential to you. You must not share them with anyone else and take reasonable steps to make sure they cannot be accessed by anyone else.

- 3.1.6 Other persons in your household must not access the scheme, the benefits or service using your identity (and you must ensure this does not happen).

- 3.1.7 Your benefits, access to, and information from our services are not for resale.

- 3.1.8 You must tell us straight away if you become aware of any unauthorised use of your user name and password or any part of your membership.

- 3.1.9 The service has been designed for members in the United Kingdom only (and in certain cases within certain regions of the United Kingdom). Not all services will be available therefore to all members.

- 3.1.10 We are constantly seeking new services for members from providers. The services are continually changing and we do not and cannot promise, represent or warrant that any particular benefits or elements of the service will be available at any particular time. We reserve the right to remove, add, change and substitute elements of the service from time to time without notice to any or all members.

- 3.1.11 You agree we are not responsible or liable for any services provided by other providers, or ourselves if you have any claims relating to service providers, you agree to make a claim against the relevant provider providing (or purporting to provide) the relevant service (including for any issues relating to the service received ).

- 3.2 Unless you tell us you wish to terminate this agreement by following the steps set out in clause
4.2 of these terms, your membership will be renewed automatically each month and you will be charged the fee (see clause 7).

4. Duration of services and your right of cancellation

- 4.1 We will automatically continue to provide the services until they are cancelled in one of the ways set out below.

-4.2 If you no longer wish to receive our services you may cancel by following this link to our 'contact us' form. The service will cancel immediately upon reaching the final confirmation page (no future payments will be debited).

- 4.3 By entering into this agreement, you've asked us to start providing the services straight-away. You agree we can treat your entering into this agreement as your express request for us to start providing the services.

- 4.4 We may immediately cancel your membership and use of the services  if:

● you misuse of the services (which means using the services in a way which is not allowed by these terms and conditions or where there is fraud); or    

● we stop providing the services or the www.carflo.co.uk website; or

● any payment that you owe us is declined, rejected, reversed or not made on time and in cleared funds.

4.5 We may also cancel your use of any of the services immediately if;

(i) you are no longer a customer of ours; or

(ii) we stop providing our services.
5. Carflo services

PLEASE READ THIS CLAUSE CAREFULLY AS IT EXPLAINS WHAT THE SERVICES ARE AND WHAT EXCLUSIONS APPLY

- 5.1 Carflo- 5.1.1 For us to be able to provide our  services to you, you need to obtain contact us on 01202 618475

- 5.1.2 Once you have activated your account and we have successfully validated your identity  we shall provide ongoing phone support to you for our range of services.

- 5.1.3  If you log in, you can cancel our services and contact us for us to be able to support you.

- 5.2 Our Serivces

- 5.2.1 Enjoy a number of great discounts up to 25% off your services, tyres and repairs from big names like Halfords, Kwik-Fit and RAC! Plus additional choices between main franchises and high quality independent dealerships.

- 5.3 Your Personal Assistant

- 5.3.1 One number for servicing, repair, accident and breakdown, and much more. Your personal assistant can even arrange a courtesy car!

- 5.4 Glass repair

- 5.4.1 Already got glass coverage? We will book all the appointments for you! If you need to get glass coverage we can get the best prices.

- 5.5 Tyres

- 5.5.1 Gain access to a large choice of tyre suppliers with up to 25% discounts. We will book any tyre change appointments for you and show you the best prices.

- 5.5 Breakdown coverage

- 5.5.1 Drive with peace of mind, knowing if anything goes wrong we’ll be there to book any breakdown recovery you need, at best prices. Even get a one day quote.

-5.6 Repair and maintenance

5.6.1 Our extensive discounted dealership network will make sure your car is always running, and when it’s time for your service, we’ll book it for you! We can even provide you with a courtesy car or a pickup & return. Branded partners for peace of mind.

-5.7 Accident support

-5.7.1 We will help you pass all the relevant information to insurance companies so you can take your time to recover. We can even help you get into a new car quickly if your old car is beyond economical repair!

6. Carflo membership

- 6.1 By entering into these terms, you wish to become a “member” of Carflo. You are only eligible to become a member if you meet the criteria in clauses 6.2 to 6.4. We will tell you if your application to become a member has been successful by giving you log in details.

- 6.2 You need to provide accurate and complete information to us including your name, email address and postal address, and the payment information.

- 6.3 A person who is not 18 years old or older does not qualify and must not, and cannot, apply for the membership. Any person who becomes a member (or purports to do so) makes a statement (which we rely on) that he or she is aged 18 years or older.

- 6.4 A person may not become a member unless they are based in the United Kingdom. A member must have a postal address in the United Kingdom. Any person becoming a member makes a statement (which we rely on) that he or she is, and will continue to be during the time they are a member, based in the United Kingdom and that person will supply a full postal address in the United Kingdom (including a valid post code).

- 6.5 For information on our privacy practices please see our privacy policy. We take privacy very seriously and act in accordance with all relevant provisions of UK data protection legislation. All personal information provided through this website or by email, such as membership enrolment information, will be handled in accordance with the privacy policy.

7. The monthly fee

- 7.3 The Fee is payable in advance. If you have given us a continuous payment authority (see clause 8) then we will use it to take the Fee unless you have cancelled this authority. If you have cancelled this authority then you must arrange for us to receive the Fee on or before the due date in cleared funds. If the Fee is not paid on time, we may suspend or cancel your right to access the services (see clause 4).

- 7.4 The first Fee is due immediately. Unless you cancel this agreement, each further Fee will be due on the same date each month. 

8. Continuous payment authority

- 8.1 When signing up to be a member, you will provide us with a continuous payment authority ("CPA") so that we can collect repayments automatically from your bank account using the debit card you nominate for this purpose.

- 8.2 If you cancel your membership we will not use the CPA to take any further payments from you and you will owe us nothing.

- 8.3 If we have been unable to take the payment of the Fee on its due date, we shall use CPA to make up to 12 further attempts for the full membership fee for up to a period of 62 days.

- 8.4 At any time during your membership we reserve the right to check the validity of your nominated debit card. You will not be charged for this but the authorisation may show on your bank statement. To prevent failed payments and save you manually updating your debit card details, we utilise an account update service. These services are offered by some card issuers to help keep your card details up-to-date in our system. Therefore, we may automatically update your card number, expiry date, or both, when notified by your card issuer.

- 8.5 To cancel this CPA you may ask us to cancel it by using the 'contact us' form. If you do not arrange for payment in any other way, your access to the service may be suspended or terminated. Cancellation of this CPA will be effective from the date that we receive such notification.

9. Security

- 9.1 Your right to access the www.carflo.co.uk website and the services is personal to you. You must not allow any other person to have access to your account on the www.carflo.co.uk website or the services using your username and password. You must keep your username and password confidential.

- 9.2 We reserve the right to suspend your access to the www.carflo.co.uk website and the services if at any time we consider that there is or is likely to be a breach of security or your use of the www.carflo.co.uk website is in any way detrimental to us or anyone else.

- 9.3 We reserve the right to require you to change any or all of the passwords used by you in connection with the www.carflo.co.uk website and/or the credit reporting and score services.

10. Copyright, trademarks and other intellectual property rights

- 10.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in the www.carflo.co.uk website

11. Our liability to you

PLEASE READ THIS CLAUSE CAREFULLY AS IT EXPLAINS WHAT LIABILITY WE HAVE TO YOU AND WHAT EXCLUSIONS APPLY

- 11.1 There are certain things which we agree we will not exclude or limit our liability to you for. These are:

- 11.1.1 Liability for death or personal injury caused by negligence;

- 11.1.2 Any other liability which we cannot limit or exclude under law.

- 11.2 Nothing in these terms and conditions affects any statutory rights you may have as a consumer. We therefore cannot, and do not, exclude or limit our liability to provide the services with reasonable care and skill.

- 11.3 Subject to clause 11.4, if we breach these terms and conditions, or are negligent, we will only be responsible for loss or damage you suffer which is foreseeable (in other words, loss which is a likely result of our breach or negligence). If the loss or damage is not foreseeable, we are not responsible for it.

- 11.4 We are not responsible to you for loss or damage or any other liability (whether it arises from breach of these terms and conditions or negligence) which is in no more than £100 for each incident.

12. Data protection, cookies and privacy policy

- 12.1 You agree that we can collect, use, transfer and disclose your personal information in accordance with our privacy policy, and you also agree to our use of cookies as described in our Privacy Policy.

13. General

- 13.1 Whilst we will try to make sure that the www.carflo.co.uk website is available for use as much as possible we cannot guarantee its availability. We may need to take it down from time to time for maintenance. We will try to do this at times when we are expecting low usage but cannot guarantee that this will be the case. No software provider can fully guarantee that its website and/or content is completely virus and bug free, but you should be aware that we are committed to trying to make all of our services as virus and bug free as we can. You should therefore use virus checking software.

- 13.2 It is important to us that the information we supply to you is as accurate as possible and we use our reasonable efforts to verify its accuracy. However, we cannot guarantee that it is completely accurate. As you will appreciate some of this information comes from other businesses, who get the information from other sources themselves such as the electoral roll, insurance companies or financial institutions. Neither we nor any other third parties used to provide the services have any control over the content of such information and are not responsible if it turns out to be inaccurate.

15. Hyperlinks to other websites

- 15.1. To provide increased value to you, we may provide links to other websites or resources for you to access. You can choose whether to access these links. Once you have left our website we are not responsible for the availability or content of these external websites or resources. We do not review or endorse the content of these websites. If you provide your personal details to these external websites then the use of these personal details will be governed by the privacy policy of that website and not our privacy policy.

16. Miscellaneous

- 16.1. We shall be under no liability for any delay or failure to deliver the services or otherwise perform any obligation under these terms and conditions if the delay or failure is caused by circumstances beyond our reasonable control.

- 16.2. If any portion of these terms and conditions is held by any competent authority (such as a court) to be invalid or unenforceable (either wholly or in part) the validity or enforceability of the other portions of these terms and conditions shall not be affected.

- 16.3. These terms and conditions do not give any rights to anyone who is not a party to them.

- 16.4. These terms and conditions and your use of the www.carflo.co.uk website and the services shall be governed by the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the courts of England and Wales in relation to any disputes arising out of or in connection with those matters.

- 16.5. You are entitled to request a paper copy of these terms and conditions from us. If you wish to receive a paper copy you can get in touch via our ‘contact us’ form to make the request.
